Welcome to the Wallkill Central School District Alumni website. This page states our terms of use, which forms the agreement under which you may use wcsdalumni.org, wcsdalumni.com, and wcsdalumni.net. Please read this page carefully. If you do not accept these terms, you will not be permitted to use this website and may be denied services that are offered.

The name Wallkill Central School District Alumni will also be known as and referred to as WCSDA.

By using this website, you are indicating that you are 18 years of age or older, that you have the legal right to enter into this agreement, and that you agree with and will abide by the terms of this agreement.

This Agreement contains the complete and entire understanding and agreement between you and the owner(s) of this website and supersedes any previous communications, representations, or agreements, verbal or written, related to the subject matter of this Agreement. This Agreement may not be modified or amended orally, impliedly, or in any manner not set forth in writing or permitted by this Agreement.

This Agreement may be amended by WCSDA at any time and without notice. Any amendments will become effective 30 days after being posted on the internet, unless circumstances require that a change be immediately implemented. As a condition for these terms you agree to periodically check this Agreement or so notably called the Terms of Use Agreement.


User Content
By using this site, you understand and agree that all text, graphics, music, sound, photographs, videos, messages, posts, data, information, or other materials ("Content") are the sole responsibility of the person with whom the Content originated. Thus, you are responsible for all content that you disseminate or transmit through or by means of this website.

You are solely responsible for anything contained in your submissions. WCSDA does not verify, endorse or otherwise vouch for the contents of any submission. You may be held legally liable for the contents of your submissions and chat sessions, and may be held legally liable if your submissions or chat sessions include, for example, material protected by copyright, trademark, patent or trade secret law or other proprietary right without permission of the author or owner, or defamatory comments.

By submitting any content that you upload or otherwise make available ("User Content") on to the website, including messages, you hereby grant to WCSDA and its affiliates a non-exclusive, perpetual, worldwide license to edit, broadcast, rerun, reproduce, use, create derivative works from, syndicate, license, print, sublicense, distribute and otherwise exhibit the User Content you submit, or any portion thereof in any manner and in any medium or forum, whether now known or hereafter devised, without payment to you or any third party.


User Conduct
You agree that you will not use the website in any way to:

1. post, disseminate, or transmit any Content that is unlawful, harassing, defamatory, abusive, threatening, obscene, harmful, tortuous, libelous, or invasive of another's privacy;


2. post, disseminate, or transmit any Content that infringes or violates any party's copyright, trademark, trade secret, patent, or other proprietary right, including, but not limited to, using third-party copyrighted materials without appropriate permission, using third-party trademarks without appropriate permission or attribution, and using or distributing third-party information (whether or not protected as a trade secret) in violation of a duty of confidentiality;


3. post, disseminate, or transmit any worms, viruses, or other harmful, disruptive, or destructive files, code, or programs;


4. post, disseminate, or transmit any unauthorized advertising, promotional materials, chain letters, spam, junk mail, or any other type of unsolicited mass e-mail to people or entities that have not agreed to be part of such mailings;


5. impersonate any person or entity; falsely state or otherwise misrepresent your affiliation with any person or entity; intentionally omit, delete, forge, or misrepresent transmission information, including headers, return mailing, and Internet protocol addresses; or otherwise manipulate identifiers to disguise the origin of any Content transmitted through the Web Site;


6. post, disseminate, or transmit any Content you do not have the right to post, disseminate, or transmit;


7. disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users' ability to engage in real-time exchanges;


8. interfere with, disrupt, or harm in any way the website or servers or networks connected to the website;


9. electronically stalk or otherwise harass another user;


10. post, disseminate, or transmit any Content that is considered pornographic;


11. engage in any activities that would violate the personal privacy rights of others, including but not limited to collecting and distributing information about other users without their permission, except as permitted by applicable law;


12. use the website for any illegal purpose, in violation of any applicable laws or regulations or in violation of the rules of any other website's providers, websites, chat rooms, or the like; or


13. intentionally or unintentionally violate any applicable local, state, national, or international law or any regulations having the force of law.

Adult-Oriented Content
WCSDA does not allow adult content and will suspend / terminate any offending account.


Privacy Policy
WCSDA's Privacy Policy explains the practices that apply to your information when you use WCSDA. Your ongoing use of this website signifies your consent to the information practices disclosed in our Privacy Policy.

Account Registration and Password
You agree and acknowledge that you are responsible for maintaining the confidentiality of your information, as defined in this Agreement, and password created upon registration on this website.

You will be fully responsible for all uses of your registration and for any activity that occurs under your password or account, whether or not authorized by you.

You agree to immediately notify WCSDA of any unauthorized use of your registration or password. WCSDA will then investigate possible violations, and take whatever action, in its sole judgment, it deems appropriate.


Account Cancellation
Your profile and free subscription will remain active until you choose to cancel your account. You may send us an email for assistance.

If you cancel your subscriber service term through our customer service, you may use your subscription until the end of your term or choose to deactivate your account immediately.

Subscribers are not eligible for a refund, or any prorated refund of any portion of subscription fees, for unused time. Once you cancel and upon expiration, your subscription will not be renewed.


Termination
Wallkill Central School District Alumni reserves the right to terminate your subscription at any time, delete any or all of your postings, or block access to the website and/or any other service provided to you by WCSDA. WCSDA reserves the right to take such actions, with or without notice, and without any liability to the account holder or user.


Indemnity
You agree to defend, indemnify, and hold harmless Wallkill Central School District Alumni, its sponsors, affiliates, successors and assigns, and their respective owners, officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Material or your breach of the terms of this agreement. WCSDA will attempt to provide notice to you promptly of any such claim, suit, or proceeding.


Governing Law
Any claim relating to Wallkill Central School District Alumni's web site shall be governed by the laws of the State of New York, without regard to its conflict of law provisions.
